Levy/BMC FOIA Request Includes Resident Comments, Emails, and Petitions
On May 22, 2026, the Zausmer firm, attorneys for Edw. C. Levy Co., submitted a FOIA request to Springfield Township seeking all records related to the proposed sand and gravel mine on Ormond Road.

The request asks for far more than official meeting packets or final reports. Levy/BMC’s attorneys are seeking Township communications, internal notes, consultant materials, Planning Commission and Township Board records, text messages, and documents connected to the Township’s review of the mining application.
Most notably, the request also asks for records related to public comments and resident communications.
That includes public comments, correspondence, complaints, statements, emails, letters, petitions, voicemail transcripts, and other communications submitted by members of the public to Township officials, employees, the Planning Commission, Township Board, or any advisory committee concerning the mining application.
Because that request involves resident-submitted materials, I reached out to Springfield Township Clerk Sean Miller out of an abundance of caution to ask how personal contact information would be handled1. Clerk Miller confirmed that before any responsive records are released to Levy/BMC’s attorneys, residents’ home addresses, personal email addresses, and telephone numbers will be reviewed and redacted as permitted under MCL 15.243(1)(a). “Thank you for raising this concern. I absolutely understand it and I can confirm that residents’ home addresses, personal email addresses, and telephone numbers will be reviewed and redacted as permitted under MCL 15.243(1)(a) prior to the release of any responsive records.
As with all FOIA requests, we will carefully review any records identified as responsive and will redact information that is exempt from disclosure under the Freedom of Information Act. At this time, Oko Environmental has the FOIA request itself, but not the records that will be produced in response to it. According to the Township’s response letter, the FOIA response is expected on or before June 15, 2026.
